Privacy Notice

In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, published in the Official Gazette of the Federation on July 5, 2010, this Privacy Notice is issued.


Identity and address of the data controller

ASOCIADOS TURÍSTICOS DE LA BAJA, S.A. DE C.V., T.I. EXPERIENCIAS EN GRUPOS Y CONVENCIONES, S.A. DE C.V., A & C INCENTIVOS, S.A. DE C.V. and TROPICAL INCENTIVES DMC, hereinafter “The Company,” is a company incorporated under Mexican law, whose corporate purpose is related to the provision of tourism services, among other activities.

“The Company” is domiciled at Avenida Tulum, Block 3, Lot 2-01, Suite 203, Cancún, Quintana Roo, Postal Code 77500, phone +52 (998) 193 3940, with Arturo Aguirre Escalante as the person responsible for the processing of personal data.

Information collected

“The Company” collects information voluntarily provided by clients, suppliers, service providers, business partners, employees, and any third party who has access to the products and/or services it offers. Such information is obtained through contracts, letters, forms, databases, or other legal means, for the purpose of documenting the legal relationship, maintaining adequate administrative records, and complying with legal and contractual obligations.

In the case of individuals, the personal data that may be collected includes full name, home address, nationality, date and place of birth, marital status, profession or occupation, business activity, contact phone numbers, email, Unique Population Registry Code (CURP), Federal Taxpayer Registry (RFC), personal references, educational information, union affiliation, health information, training information, safety and environmental tests, income information, gender, bank details, salary information, and tax identification numbers. In the case of legal entities, personal data may include name or business name, corporate purpose, Federal Taxpayer Registry, fiscal address, date of incorporation, nationality, phone numbers, email or website, as well as the name, nationality, and data of the person authorized to legally bind the legal entity.

Confidentiality and processing of personal data

Personal data, including sensitive personal data, is treated in a strictly confidential manner. “The Company” implements administrative, technical, and physical measures to protect the information and prevent its loss, misuse, unauthorized access, disclosure, or alteration. Personal data is used to comply with legal and contractual obligations, personnel administration, suppliers and services, operational coordination, and emergency response. With the exception of sensitive personal data, the information may also be used for advertising, promotion, telemarketing, website administration, development of new products and services, quality and satisfaction surveys, service usage analysis, and sending notifications related to products and services operated by “The Company,” its affiliates, subsidiaries, or business partners, when permitted by law.

Sensitive personal data is considered to be data that affects the most intimate sphere of the data subject or whose misuse may give rise to discrimination or represent a risk to the data subject, including information related to health status, racial or ethnic origin, religious, philosophical, or moral beliefs, union affiliation, political opinions, and sexual preferences. This data is used solely for purposes related to business management, the employment relationship, or the provision of services. “The Company” does not require prior consent from the data subject for the processing of personal data in cases expressly permitted by law, such as compliance with legal or contractual obligations, emergency situations, medical care, resolutions from competent authorities, or when the data comes from publicly accessible sources.

Limitation of use and disclosure of data

Personal data will be used and, where applicable, transferred solely to fulfill the purposes set forth in this Privacy Notice, as well as for statistical, dissociated purposes, and for the improvement of products, services, and internal operations. Transfers of personal data to third parties will only be made when necessary to comply with legal obligations, judicial or administrative resolutions, or for the proper operation of “The Company,” always ensuring an adequate level of protection.

“The Company” will take the necessary measures to cancel or dissociate personal data when it is no longer necessary for the intended purposes or when there is no legal obligation to retain it.

Means to exercise ARCO rights

The data subject may exercise at any time their rights of Access, Rectification, Cancellation, or Opposition through a written request addressed to “The Company.” Such request must contain the name of the data subject, a means to communicate the response, documents proving their identity or legal representation, a clear description of the data regarding which they seek to exercise the corresponding right, and any other element that facilitates its location.

Revocation of consent

The data subject may revoke at any time the consent granted for the processing of their information, by submitting a request through the same means indicated for the exercise of ARCO rights, complying with the applicable legal requirements.

Modifications to the privacy notice

“The Company” reserves the right to modify this Privacy Notice at any time. Modifications will be communicated through visible notices at its facilities or through notifications directed to employees, clients, or related third parties.

Additionally, any disagreement related to the processing of personal data may be filed with the National Institute of Transparency, Access to Information, and Protection of Personal Data (INAI), in accordance with applicable legislation. This Privacy Notice is governed by the Federal Law on the Protection of Personal Data Held by Private Parties, the Federal Civil Code, and other applicable legal provisions.
